www.ublossom.ch is published by ublossom chocolats, raison individuelle, whose head office is located in Le Petit-Lancy.
APPLICATION OF THE GENERAL CONDITIONS OF SALE
The general terms and conditions of sale detailed below apply to all orders for products and services placed via this Website with ublosssom chocolates by any person (the “Customer”).
The Customer must read the GCS before placing any order (the “Order”), the GCS being available on the Website.
Ublossom Chocolats reserves the right to adapt or modify these GCS at any time. The version of the GTC applicable to any sale is the one appearing online on the www.ublossom.com website at the time of the Order. Consequently, the fact of placing an Order requires the Customer’s full and unconditional acceptance of the GCS by clicking on the “I have read and accept the general terms and conditions of sale” button.
INFORMATION ON THE SITE AND ACCESSIBILITY OF THE SITE
www.ublossom.ch is an e-commerce site owned and managed by Ublossom chocolates.
The Website is accessible to all users of the internet network on principle 24 hours a day, 7 days a week, except in the event of an interruption, scheduled or otherwise, by Ublossom chocolats or its service providers, for the purposes of maintenance and/or security or in the event of force majeure (as defined below). Ublossom chocolats shall not be held liable for any damage, of whatever nature, resulting from the unavailability of the Website.
Ublossom Chocolats does not guarantee that the Website will be free of anomalies, errors or bugs, nor that the Website will function without breakdown or interruption. In this respect, Ublossom Chocolates may freely and at its sole discretion determine any period of unavailability of the Website or its content. Ublossom Chocolates cannot be held responsible for problems of data transmission, connection or network unavailability.
Ublossom chocolats reserves the right to make changes to the Website for technical or commercial reasons. When these modifications do not alter the conditions for the provision of services in a substantial and negative manner, the Customer may be informed of the modifications made, but his acceptance is not requested.
REGISTRATION ON THE SITE
In order to place an Order, the Customer must first register on the Site by creating an account containing the Customer’s information (the “Account”).
The Customer’s registration on the Site is validated by [name of the company] after verification of the standard form filled in by the Customer. The Customer will receive an e-mail confirming registration.
When creating his Account, the Customer must ensure that the data he provides is accurate and complete. The Client is obliged to always update his personal information. In the event of an error in the wording of the addressee’s details, Ublossom shall not be held liable for the impossibility of delivering Products.
By registering on the Website, the Customer declares and guarantees to [name of company] that he/she is of legal age and has the legal capacity to enter into a contract.
Ublossom may delete the Customer’s Account at any time, for any reason, at its sole discretion.
The Products offered for sale are those described on the Site on the day the Customer consults the Site, within the limits of available stocks. These indications are automatically updated in real time. However, Ublossom Chocolates shall not be held liable for any error in the update, whatever its origin. Ublossom Chocolats shall not be held liable for the cancellation of an Order of a Product due to the exhaustion of stocks.
Ublossom Chocolats takes the greatest care in the presentation and description of its products to best satisfy the Customer’s information. It is however possible that errors may appear on the Website, which the Customer acknowledges and accepts.
Ublossom Chocolats guarantees neither the accuracy nor the security of the information transmitted or obtained by means of the Website.
The taking of Orders on the Website is subject to compliance with the procedure set up by Ublossom Chocolates on the Website comprising successive stages leading to the validation of the Order.
The Customer may select as many Products as he/she wishes to add to the basket (the “Basket”). The Basket summarises the Products chosen by the Customer as well as the prices and related costs. The Customer may freely modify the Basket before confirming his Order. Confirmation of the Order shall constitute confirmation of the Customer’s acceptance of the GCS, the Products purchased, their prices and the associated costs.
A confirmation e-mail summarizing the Order (Product(s), price, availability of the Product(s), quantity, etc.) shall be sent to the Customer by Ublossom Chocolates. To this end, the Customer formally accepts the use of electronic mail for the confirmation by [name of the company] of the contents of his Order. Invoices are available in the “my account” section of the Website.
Each person placing an Order accepts without restriction the General Terms and Conditions of Sale.
The client is responsible for any information given concerning the delivery address. Ublossom_chocolats shall not be held responsible for any typing errors made by the client which may render the delivery impossible or late. In the event that a parcel is re-routed, the delivery costs are to be borne by the customer.
We reserve the right to interrupt sales on public holidays, during the months of July and August or at other times of the year.
Christmas orders should preferably be placed before 15 December as we may be unable to fulfil them after this date.
Ublossom_chocolats has the right to refuse an order if the information provided is incorrect or inaccurate or for legal reasons.
PRICES AND PAYMENT TERMS
The prices of the products are indicated on the Site in CHF, including VAT, but excluding customs duties and other taxes. Customs duties and other taxes must be paid by the Customer directly to the carrier.
All prices displayed are calculated and include the value added tax (VAT) applicable in Switzerland or that applicable in the country of delivery located in the European Union.
Ublossom Chocolats reserves the right to modify its prices at any time, but the Products shall be invoiced on the basis of the prices in force at the time of registration and payment of the Order, subject to availability.
You also have the possibility to pay the amount due on the postal account kukikila Bindanda Pineiro ccp 92-935817-1. When you place your first order, we will wait for the validation of the payment to send the parcel.
Payment is made via the secure platform of our payment service provider PAYPAL.
The Customer expressly acknowledges that the communication of his credit card number to Ublossom Chocolates shall constitute authorisation to debit his Account up to the price of the Products ordered. Where applicable, a notification of cancellation of the Order for non-payment shall be sent to the Customer by Ublossom Chocolates to the email address communicated by the Customer when registering on the Website.
The data recorded and stored by Ublossom Chocolats shall constitute proof of the Order and of all sales made. The data recorded by PAYPAL shall constitute proof of any financial transaction between the Customer and Ublossom chocolats.
Deliveries outside the city of Geneva are handled by La Poste’s services in Economy Pac . Deliveries within the city of Geneva will be made by a delivery man. All orders are dispatched on Wednesdays. Please pay attention to the special conditions before the holidays (see general conditions).
